Immigration Laws in Georgia.

Immigration law is primarily federal, but Georgia has enacted significant state-level immigration enforcement legislation. HB 87 (2011) requires employers with more than 10 employees to use E-Verify and authorizes law enforcement to check immigration status. HB 1105 (2024) expanded these requirements further. Georgia bans local sanctuary policies, does not issue driver's licenses to undocumented residents, and requires verification of immigration status for public benefits.

E-Verify RequirementO.C.G.A. § 13-10-91

All private employers with more than 10 employees must use E-Verify for new hires. Public employers must comply regardless of size. Contractors providing $2,500+ in services to public entities must also comply.

Sanctuary Policy BanO.C.G.A. § 36-80-23

Local governments and law enforcement agencies are prohibited from adopting sanctuary policies that limit cooperation with federal immigration authorities. HB 1105 (2024) expanded enforcement and requires local agencies to pursue 287(g) agreements.

Driver's License RequirementsO.C.G.A. § 40-5-21.1

Georgia does not issue driver's licenses to undocumented residents. Valid immigration status or work authorization is required. Asylum seekers with work permits are eligible.

Public Benefits VerificationO.C.G.A. § 50-36-1

Applicants for state or local public benefits must verify lawful immigration status under the Secure and Verifiable Identity Document Act.
