Immigration Laws in New York.

Immigration law is primarily federal, but New York has some of the strongest state-level protections for immigrants in the country. The Green Light Law provides driver's licenses to all residents regardless of immigration status and prohibits DMV data sharing with federal immigration authorities. New York's DREAM Act provides state financial aid to undocumented students. NYC adds further protections including municipal ID, funded deportation defense, and limits on ICE cooperation.

All residents can obtain a non-commercial driver's license regardless of immigration status. The DMV is prohibited from sharing license information with federal immigration authorities without a judicial warrant or court order.

Wage Protections for Immigrant WorkersN.Y. Lab. Law § 215

Prohibits employers from threatening to contact immigration authorities or reporting an employee's suspected immigration status as a form of retaliation. All labor protections apply regardless of immigration status.

Jose Peralta New York State DREAM ActS.1250 (2019)

Allows undocumented students who attended NY high schools to access state financial aid (TAP, Excelsior Scholarship) and 529 college savings programs on the same terms as citizens.

Sanctuary PoliciesExecutive Order 170 (2017); NYC Executive Order 41

State executive orders prohibit state agencies from inquiring about or disclosing immigration status in most circumstances. NYC limits NYPD cooperation with federal immigration detainers absent a judicial warrant and provides funded legal representation for immigrants in deportation proceedings.
