Immigration Laws in Idaho.

Immigration law is primarily federal, but Idaho has taken a strict enforcement posture at the state level. Idaho does not issue driver's licenses to undocumented immigrants, does not have sanctuary policies, and has enacted legislation requiring cooperation with federal immigration enforcement. Recent legislation has moved toward mandatory E-Verify for employers.

Idaho prohibits state and local government entities from enacting sanctuary policies that limit cooperation with federal immigration enforcement agencies.

Federal Immigration Enforcement CooperationIdaho Code § 19-6102

Idaho law requires state and local law enforcement to cooperate with federal immigration authorities and prohibits policies that restrict such cooperation.

Driver's License RequirementsIdaho Code § 49-306

Idaho requires proof of lawful presence in the United States to obtain a driver's license or identification card. Undocumented immigrants are not eligible for Idaho driver's licenses.

E-Verify LegislationIdaho Senate Bill 1247 (2026 session)

Idaho has introduced legislation to require all employers to use the E-Verify system to confirm employment eligibility of new hires, with an anticipated effective date of January 1, 2027. This builds on existing requirements for state contractors.
