Immigration Laws in Maryland.

Maryland is generally immigrant-friendly. The state provides driver's licenses to all residents regardless of immigration status (though not REAL ID-compliant for undocumented applicants). The Maryland DREAM Act provides in-state tuition for undocumented students. In 2025, Governor Moore signed legislation prohibiting local governments from entering into 287(g) agreements with ICE. Individual jurisdictions (Baltimore City, Montgomery County, Prince George's County) have varying cooperation policies with federal immigration enforcement.

Driver's Licenses for All ResidentsMd. Code, Transp. § 16-103 (Highway Safety Act of 2013)

Maryland provides driver's licenses to all eligible residents regardless of immigration status. Licenses issued to those without proof of legal presence are not REAL ID-compliant and cannot be used for federal identification purposes (boarding flights, entering federal buildings), but are valid for driving.

Maryland DREAM Act (In-State Tuition)Md. Code, Educ. § 15-106.8

Allows undocumented students to qualify for in-state tuition at public colleges. Requirements: attended and graduated from a Maryland secondary school, parent/guardian filed Maryland income tax returns for 3+ years, registered within 6 years of graduation. Students must first attend a community college for 60 credits or earn an associate's degree before transferring to a 4-year institution with in-state tuition.

TRUST Act (ICE Cooperation Limits)Md. Code, Corr. Serv. § 4-601 (2020)

Limits state and local cooperation with ICE civil immigration detainers. Local law enforcement generally cannot hold individuals solely on an ICE detainer without a judicial warrant.

287(g) Agreement Prohibition2025 Legislation (effective 2026)

Governor Moore signed legislation prohibiting local governments from entering into or renewing 287(g) agreements with ICE that would deputize local law enforcement officers to enforce federal immigration law.
