Immigration Laws in New Jersey.
New Jersey's Immigrant Trust Directive (AG Directive 2018-6) limits law enforcement cooperation with ICE, though it is an executive directive rather than statute (legislation to codify it is advancing as of 2026). NJ issues standard driver's licenses regardless of immigration status since May 2021. The NJ DREAM Act/Tuition Equality Act provides in-state tuition and state financial aid to qualifying undocumented students.

Limits voluntary assistance NJ law enforcement may provide to ICE. Officers may not stop, question, arrest, search, or detain anyone solely based on immigration status, and may not ask about status during routine encounters. Legislation to codify into permanent statute is advancing as of 2026.
NJ issues a "Standard Driver's License" (not REAL ID-compliant) to all residents regardless of immigration status, effective May 1, 2021. The MVC is prohibited from providing data to immigration enforcement agencies absent a court order.
Students who attended a NJ high school for 3+ years and graduated qualify for in-state tuition at public colleges regardless of immigration status. P.L.2018, c.12 extended state financial aid eligibility (TAG grants, etc.) to qualifying undocumented students.
