Product Liability Laws in Massachusetts.

Massachusetts product-liability law applies negligence, breach-of-warranty, and statutory theories against sellers and manufacturers of defective products. Massachusetts has not adopted full strict product liability under Restatement § 402A; instead, much Massachusetts product practice proceeds through breach of the implied warranty of merchantability coupled with Chapter 93A. Massachusetts’s 3-year personal-injury statute of limitations generally applies.
