Employment Laws in Nevada.

Nevada protects more classes than federal law, including sexual orientation, gender identity, and wage discussion. The state moved to a single-tier minimum wage of $12.00/hour in 2024. Nevada has a unique daily overtime rule — employees earning less than 1.5x minimum wage get overtime after 8 hours in a day. Nevada is one of only 11 states recognizing the implied covenant of good faith and fair dealing as an at-will exception.

Employment Discrimination (NERC)NRS 613.330

Prohibits discrimination based on race, color, religion, sex, sexual orientation, gender identity or expression, age, disability, national origin, and wage discussion. Enforced by the Nevada Equal Rights Commission (NERC). Complaints must be filed within 300 days.

Minimum WageNRS 608.250

Single-tier minimum wage of $12.00/hour for all employees (effective July 1, 2024). The previous two-tier system based on employer health benefits was eliminated by voter-approved constitutional amendment.

Daily OvertimeNRS 608.018

Employees earning less than 1.5x minimum wage ($18.00/hour) receive overtime after 8 hours in a workday or 40 hours in a workweek. Employees earning $18.00+/hour receive overtime only after 40 hours/week. This daily overtime threshold is unusual among states.

Tip ProtectionsNRS 608.160

Employers cannot take tips from employees or apply tips toward minimum wage.

At-Will Exceptions (Including Good Faith)Common law

Nevada recognizes three at-will exceptions: public policy, implied contract (from handbooks/policies), and implied covenant of good faith and fair dealing. Nevada is one of only 11 states recognizing the good faith exception.

Whistleblower Protection (Public Employees)NRS 281.611–281.671

Public employees are protected from retaliation for reporting "improper governmental action." Private employees are protected from retaliation for filing complaints or testifying in proceedings (NRS 613.340).
