New Mexico noncompete enforceability is subject to a reasonableness test. New Mexico had a longstanding narrow approach, and HB 1201 (2022) significantly restricted noncompetes for healthcare workers. New Mexico has no specialized business court but complex commercial cases are handled by individual district-court judges.

Noncompete Enforceability — Healthcare RestrictionNMSA 1978 § 24-1I-1 et seq. (Healthcare Noncompete) + common law

HB 1201 (2022) prohibits noncompetes for healthcare workers except in specified contexts. General (non-healthcare) noncompetes remain governed by common-law reasonableness review — must be reasonable in duration, geography, and scope to protect a legitimate business interest.

New Mexico Uniform Trade Secrets ActNMSA 1978 §§ 57-3A-1 et seq.

Provides civil remedies for misappropriation of trade secrets including injunctive relief, damages, and exemplary damages up to 2x for willful misappropriation.
