New Mexico healthcare law combines federal frameworks (Medicare, Medicaid, ACA, HIPAA, EMTALA) with state-specific statutes governing facility licensing (through the Department of Health) and professional licensing (through various boards under the Regulation and Licensing Department). New Mexico does NOT maintain a Certificate of Need program (one of only a few states). New Mexico expanded Medicaid effective January 2014. New Mexico has been a leading state on reproductive-health protection — codifying abortion access in 2021 (SB 10). The state operates a Prescription Monitoring Program.

New Mexico is one of approximately 12 states without a Certificate of Need program. Healthcare facility development is regulated through licensing rather than CN.

Medicaid ExpansionNMSA 1978 § 27-2-12 et seq.

New Mexico expanded Medicaid effective January 2014. Covers adults up to 138% of the federal poverty level. New Mexico's Medicaid enrollment rate is among the highest in the nation per capita.

Respect New Mexico Women and Families Act (SB 10, 2021)NMSA 1978 § 30-5-1 (repealed)

Repealed New Mexico's pre-*Roe* 1969 abortion ban, codifying abortion access. New Mexico became a regional safe-haven for abortion care after *Dobbs* (2022).

Prescription Monitoring ProgramNMSA 1978 § 30-31-27.2

New Mexico operates a mandatory PDMP through the Board of Pharmacy. Prescribers must check the PDMP before prescribing controlled substances in most circumstances.
