Insurance Disputes Laws in Virginia.

Virginia insurance is regulated by the State Corporation Commission, Bureau of Insurance, under Title 38.2 of the Code of Virginia. Virginia is a traditional fault (tort) auto-insurance state — not a no-fault state — with mandatory minimum liability coverage and mandatory uninsured/underinsured motorist coverage under Va. Code § 38.2-2206. Virginia does not recognize a broad common-law bad-faith tort for first-party coverage disputes; Virginia instead relies on Va. Code § 38.2-209 (attorneys' fees for unreasonable denial of a claim) and the Virginia Consumer Protection Act where applicable.
