Domestic Violence Laws in Mississippi.

Mississippi's Protection from Domestic Abuse Act authorizes emergency, temporary, and final protection orders through the Chancery, County, Circuit, or Justice Court. Emergency orders may issue ex parte with immediate effect lasting up to 5 business days; final orders may last up to 1 year and are renewable. Mississippi also criminalizes domestic violence as a separate offense with enhanced penalties for repeat violations. Federal firearm dispossession under 18 U.S.C. § 922(g)(8) applies to qualifying orders.

Permits a victim of domestic abuse to seek emergency, temporary, or final protection orders. Remedies include no-contact, residence exclusion, temporary custody, support, and firearms surrender.

Domestic Violence (Criminal)Miss. Code Ann. § 97-3-7

Simple domestic violence (first offense) is a misdemeanor. Third offense within 7 years is a felony. Aggravated domestic violence (serious bodily injury, weapon, or strangulation) is a felony with 2–20 years imprisonment.

StalkingMiss. Code Ann. § 97-3-107

Simple stalking is a misdemeanor (up to $1,000 fine and 1 year jail). Aggravated stalking (with weapon, violating protective order, or after prior stalking conviction) is a felony.

Crime Victim CompensationMiss. Code Ann. § 99-41-1 et seq.

Mississippi's Crime Victim Compensation Program reimburses victims for medical, counseling, and economic losses. Application must be filed within 3 years of the crime.
