Insurance Disputes Laws in New Hampshire.

New Hampshire insurance law includes the Unfair Insurance Trade Practices Act (RSA Chapter 417) with enforcement through the Department of Insurance. New Hampshire does NOT recognize a private cause of action under the UITPA — enforcement is by the Commissioner. New Hampshire recognizes common-law bad faith based on breach of the implied covenant of good faith and fair dealing. Third-party insurer bad-faith failure to settle within policy limits is actionable. New Hampshire Consumer Protection Act (RSA 358-A) may also apply to certain insurance disputes.
