South Dakota environmental law combines federal programs (RCRA, CERCLA, CWA, CAA) with state implementation through the Department of Agriculture and Natural Resources (DANR). South Dakota's environmental practice is dominated by (1) agricultural water-quality issues (feedlots, nutrient management); (2) mining issues (Black Hills gold mining legacy and ongoing operations); (3) oil-and-gas regulation (Bakken Formation periphery in northwestern SD); and (4) water rights under prior-appropriation doctrine administered by the Water Management Board. Ellsworth Air Force Base-related environmental matters are also significant.
