Nevada environmental law combines federal programs (RCRA, CERCLA, CWA, CAA) with state implementation through the Nevada Division of Environmental Protection (NDEP). Nevada has substantial mining-related environmental regulation (particularly for precious-metal mining in the northern counties) under the Nevada Mining Reclamation Act. Water law is governed by prior-appropriation principles (first in time, first in right) administered by the State Engineer. Nevada's arid climate and limited water resources produce active surface- and groundwater-rights litigation.

Nevada follows the prior-appropriation doctrine. Surface- and groundwater rights are administered by the Nevada State Engineer. Basin-by-basin management with numerous over-appropriated basins in southern and western Nevada.

Mining ReclamationNRS Chapters 519A, 519B

Mining operations must submit reclamation plans, post bonds, and comply with permitting through NDEP and the Division of Minerals. Nevada is the largest gold-producing state.

Nevada Air Quality LawNRS Chapter 445B

Authorizes NDEP to administer air quality programs under delegated CAA authority. Clark County operates its own Department of Environment and Sustainability for air quality in the Las Vegas area.
